Miami-Area Rules & Regulations
State of Florida
The state prohibits whole-unit rentals in homestead-exempted properties. Operators that rent for less than 30 days more than three times a year are required to obtain a Vacation Rental License from the Department of Business and Professional Regulation.
Miami-Dade County
Short-term rental operators in unincorporated parts of the county are required to obtain a Certificate of Use from Regulatory and Economic Resources, cap occupancy to two per bedroom, plus two; prohibit parties, and maintain a guest registry for two years. In Estate/Low-Density residential zones, operators must reside onsite for more than six months per year.
City of Miami
Short-term rentals are governed by the city’s land use law, which generally allows them in commercial/hotel districts and prohibits them in residential areas.
MIAMI BEACH
STRs in Miami Beach must obtain a certificate of use and a resort tax registration certificate from the City. STRs are prohibited in all single-family homes and in multifamily housing buildings in certain zoning districts of Miami Beach. The city has hyper-aggressive code enforcement that has evicted guests from unpermitted STRs.
Miami Gardens
STRs in Miami Gardens, home to Miami Stadium, must hold a valid registration. Each rental requires a separate application. A summary of STR registration requirements for Miami Gardens can be found here, on page 24.
Miami Springs
Short-term rental operators are required to register with the city and limit occupancy to two people per bedroom and no more than 10 guests per unit.
